Negotiated Rate Agreement
Kindly note that a booking of Goods/Cargo (as Shipper or as authorized agent of the Shipper) with Peters & May USA Inc (also dba as Compass Marine) after receiving the terms of this Negotiated Rate agreement (“NRA”) or any later NRA amendment constitutes acceptance of the rates and the terms and conditions therein. The Quote and/or Booking Note/Confirmation (including any rate quote) and the Merchant/Customer’s written acceptance, compromises the NRA (PER 46 C.F.R. PART 520.13 and 532, ET SEQ.) The Booking Note/Confirmation Number (or where only a Quote is issued, the Quote Number) is the NRA Number. The NRA is valid for the Vessel/Voyage/Departure mentioned. Rates are fixed as of the following dates: (i) for LCL Cargo, the relevant CFS cut-off date, and (ii) for FCL or BBLK the relevant terminal in-gate date. In the event of a lack of written acceptance by the Merchant/Customer, receipt of the Goods/Cargo shall be deemed acceptance the NRA or amended NRA. Should the Vessel or Voyage change a new, or amended, NRA will be made automatically at that point. Any charges by the Carrier without appropriate notice (46 C.F.R. 520.8) shall be passed through to the Merchant/Customer/Shipper without mark-up. This NRA may include demurrage, detention, per diem, free time, waiting time, penalties, incentives, service standards, freight forwarder compensation, and other similar charges. This NRA is subject to general rate increases unless otherwise stated on the Quote or Booking Confirmation.
